DMCA Policy

CueSoul.ai respects intellectual property rights and complies with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. § 512. This policy explains how to submit a copyright infringement notice and how CueSoul responds to such notices.

Important: CueSoul is a platform for AI-original music where artists declare full ownership at submission. All submitted tracks include an ownership declaration. However, if you believe content on our platform infringes your copyright, follow the process below and we will respond promptly.


1. DMCA Safe Harbor

CueSoul qualifies for safe harbor protection under the DMCA as an online service provider that hosts user-submitted content. To maintain this protection, CueSoul responds expeditiously to valid takedown notices and has a policy of terminating repeat infringers.

2. Submitting a Copyright Infringement Notice (Takedown Request)

If you believe content on CueSoul.ai infringes your copyright, you must submit a written notice containing ALL of the following elements required under 17 U.S.C. § 512(c)(3):

  1. Your signature (physical or electronic) as the copyright owner or authorized agent
  2. Identification of the copyrighted work you claim has been infringed — provide specific title, registration number if available, and description
  3. Identification of the infringing material — provide the specific URL(s) on CueSoul.ai where the infringing content appears
  4. Your contact information — name, address, telephone number, and email address
  5. A statement of good faith belief — "I have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law."
  6. A statement of accuracy under penalty of perjury — "The information in this notification is accurate, and I am the copyright owner or am authorized to act on behalf of the owner."

Warning: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorney's fees. Do not submit a takedown notice if you are not the copyright owner or authorized agent.

Email submission is preferred for fastest response. Include "DMCA Takedown Notice" in the subject line.

3. CueSoul's Response Process

  1. Upon receipt of a valid, complete DMCA notice, CueSoul will acknowledge receipt within 3 business days
  2. CueSoul will notify the affected artist of the takedown notice
  3. If the notice meets all DMCA requirements, CueSoul will remove or disable access to the allegedly infringing content within 10 business days pending counter-notification
  4. CueSoul will investigate the artist's ownership declaration on file
  5. CueSoul will provide the complaining party with confirmation of removal

4. Counter-Notification (Artist Response to Takedown)

If you are an artist whose content was removed and you believe the removal was in error or the result of misidentification, you may submit a counter-notification containing:

  1. Your physical or electronic signature
  2. Identification of the material removed and its location before removal
  3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification
  4. Your name, address, and telephone number
  5. A statement consenting to jurisdiction of the federal district court for the district in which your address is located

Submit counter-notifications to: legal@cuesoul.ai with subject "DMCA Counter-Notification."

Upon receipt of a valid counter-notification, CueSoul will notify the original complainant and may restore the content within 10–14 business days unless the complainant files a court action.

5. Repeat Infringer Policy

CueSoul maintains a strict repeat infringer policy. Artists who receive two or more valid, uncontested DMCA takedown notices will have their accounts permanently terminated without refund. This policy is necessary to maintain CueSoul's DMCA safe harbor protection.

6. False Ownership Declarations

All CueSoul artists sign an ownership declaration at submission. An artist who submits music they do not own — resulting in a valid DMCA takedown — is in material breach of the Artist Agreement and subject to immediate account termination and potential legal action by CueSoul for damages incurred in processing the dispute.
